For most of our clients, the last thing they want is to see their name in a lawsuit, the newspaper, or their lawyer’s web site. While many of our cases are resolved quickly, quietly and discretely, we can share some of our successes:
- Managed litigation and arbitration arising from massive misappropriations of money and assets by the managers and trustees of a family business, resulting in the award of millions of dollars in damages and investigations of the wrongdoers by a variety of state and federal agencies.
- Won the dismissal of professionals in bankruptcy litigation seeking $1 billion in damages following the collapse of an Arizona-based mortgage lender.
- Obtained the dismissal of utility defendants in class action lawsuits brought on behalf of approximately 10,000 homeowners before costly class certification, motions and settlement proceedings against other defendants.
- Served as local counsel in the successful defense of other class action cases involving securities, employee claims, polybutylene plumbing and others.
- Successfully defended federal lawsuit alleging attorney billing fraud, resulting in the dismissal of the lawsuit on the pleadings.
- Successfully defended claims by a well-known PGA golfer against a national golf store company in a dispute over licensing fees, with the PGA player paying our legal fees when the case was over.
- Won dismissal for judges who were sued by their judicial assistant for sexual harassment, wrongful termination and other claims in a high-profile case.
- A national pet store company sued a major accounting firm for hundreds of millions of dollars due to alleged problems with the integrated computer and accounting systems installed by the firm. Working with the defense team, the vast majority of claims were dismissed on summary judgment, and the rest of the case was dismissed shortly thereafter.
- Plaintiffs in the largest condemnation litigation in Arizona history moved to disqualify the government’s counsel after years of litigation, potentially putting at risk millions of taxpayer dollars. After a de facto trial, our lawyer-clients remained on the case.
- Successfully defended police defendants after a process server who shot a citizen while serving papers and fled the scene sued the police for false arrest. The police were exonerated after six-week jury trial and multiple appeals by the shooter.
- Helped the widow of a U.S. Army Ranger obtain the replacement marriage license she needed to secure survivors’ benefits for herself and two small children.
- Helped the homeless and other individuals in need on a pro bono basis. Russ was named one of the “Top 50 Pro Bono Attorneys in Arizona” by the State Bar in the inaugural year of this award (2002).
